b"Chaim Saiman is a world renowned scholar who holds the Chair in Jewish law at Villanova University. He is the author of the book,Halakhah: The Rabbinic Idea of Law which has met with wide acclaim.Professor Saiman regularly guides law students in the finer points of contracts, insurance regulations and coverage disputes and stresses the responsibilitythat citizens have towards each other'sprivate property. He also is an instructor each semester to a select group of aspiring lawyers taking his groundbreaking courses in Jewish Law.Rabbi Kivelevitz questions Professor Saiman on the challenges and rewards of giving over information culled primarily from the Talmud and the Halachic codes to students that are representative of all walks of American life.Saiman spells out his approach for conveying honestly the finer details of sugyos to non-Jews,without resorting to obvious apologia. He articulates his case that the Yeshiva trained students in his lectures are gaining an appreciation for Gemara material in mature authentic ways that were unavailable in the Yeshivos they studied in.Taking Hashavas Aveidah and Kibbud Av as examples ,the Professor indicates how the sources studied with respect and depth yield telling precedents to the foundations of American legal principles that continue to be fleshed out by legal scholars.Saiman sees his Yeshivish students as the vanguard of a growing dynamic sort of ba\\u2019al habos, thoroughly American, assiduous and identifiable as a Charedi. It had been assumed that such a community could not exist.Roshei Yeshiva from their side and sociologist and scholars of American religion from their side each used their own language to argue that economic and educationalintegration wouldinevitably lead to social and cultural integration, making the charedi side of the equation untenable.Saiman's students have defied these expectations. They and thousands of other former Yeshiva students in the fields of medicine, engineering and the social sciences havecreateda modern, partially integrated, orthodox society that is neither Modern Orthodox nor Ultra-Orthodox.Kivelevitz wonders if this newly formed wing can meet the challenges our communities are facing in a way that is legitimate and adheres to Daas Torah while wielding an inventive power that posits Klal Yisroel as leaders in the world.Professor Saiman has served as the Gruss Visiting Professor of Talmudic Law at both Harvard Law School and the University of Pennsylvania Law School, a visiting fellow at Princeton University and a visiting professor at the University of Toronto, Bar-Ilan, Hebrew University and IDC faculties of law.Saiman sits as a rabbinical court judge (dayyan) with the Beth Din of America andservesas an expert witness in insurance law and Jewish law in federal court.Professor Saiman received his B.S. from Georgia State University, and his J.D. from Columbia University School of Law. He also studied for a number of years at Yeshivat Har-Etzion (Gush) and Yeshivat Kerem B\\u2019Yavneh in Israel. Prior to joining the faculty at Villanova, he was an Olin Fellow at Harvard Law School a Golieb Fellow at NYU Law School, a law clerk to Judge Michael McConnell on the Tenth Circuit Court of Appeals, and worked as a corporate associate with the firm Cleary Gottlieb in New York. Please leave us a review or email us at ravkiv@gmail.comfind out more about this podcast fromyeshivaofnewark.jewishpodcasts.org See acast.com/privacy for privacy and opt-out information.
