  2. The Sussex County Circuit Court erred and abused its discretion in Granting the defendant\\u2019s Motion for Summary Judgment upon its finding that the Evidence produced and Submitted by Appellant Albritton was insufficient from which a jury could find the defendant guilty of negligence.
  3. The Sussex County Circuit Court erred and abused its discretion in Granting the defendant Commonwealth\\u2019s Motion for Summary Judgment for Contributory negligence based solely upon the inadmissible Hearsay Evidence submitted by the defense.
