The Court of Appeals erred in finding no error where the trial Court erred in denying Counsel’s Motion to Strike on the grounds of insufficient evidence for a showing that the defendant received an overpayment of two hundred dollars or more, thereby making it a felony as opposed to a misdemeanor.
