The circuit court erred in granting, at the close of Cromartie’s case-in-chief, Billings’s motion to strike Cromartie’s claim of an unlawful search in violation of Code § 19.2-59, and erred in denying Cromartie’s motion to reconsider this decision, and erred by consequently entering summary judgment for Billings on this claim based on striking the claims.

The circuit court erred in granting, at the close of Cromartie’s case-in-chief, Billings’s motion to strike Cromartie’s 42 U.S.C. § 1983 claim of excessive force in violation of the Fourth Amendment, and erred in denying Cromartie’s motion to reconsider this decision, and by consequently entering summary judgment for Billings on this claim based on striking the claims.

 

  1. The circuit court erred in granting, at the close of Cromartie’s case-in-chief, Billings’s motion to strike Cromartie’s 42 U.S.C. § 1983 claim of false arrest in violation of the Fourth Amendment for the obstruction of justice charge, and erred in denying Cromartie’s motion to reconsider this decision, and by consequently entering summary judgment for Billings on this claim based on striking the claims.
