Granted Appeal Summary
Case
WORLD TELECOM EXCHANGE COMMUNICATIONS, LLC v. YACOUB SIDYA (Record Number 180901)
From
The Circuit Court of Fairfax County; B. White, Judge.
Counsel
Virginia Whitner Hoptman and James S. Kurz, (Redmond, Peyton & Braswell LLP) for appellant.
Ellen D. Marcus and Sheila M. Costin (Holmes Costin & Marcus PLLC) for appellee.
Assignments of Error
- The circuit court erred when it granted Sidya’s Motion to Dismiss Plaintiff WTXC LLC's claims, which was based on (a) a flawed reading of the July 20 Order, (b) misconstruction of agency law, and (c) the misapplication of the doctrine of the law of the case to vacated postverdict Orders.
- The circuit court erred when it denied WTXC LLC's Motion for Entry of Partial Final Judgment based on the same flawed reading of the July 20 Order and misconstruction and misapplication of Virginia law and denied WTXC LLC the right to have judgment entered on the jury verdict in its favor, awarding substantial damages, punitive damages and attorneys' fees, and to have the record reflect the truth.
