From the Court of Appeals of Virginia

Granted Appeal Summary:

Assignment of Error

The trial court erred in denying the Defendant’s motion to suppress as his Fourth Amendment rights against illegal search and seizure were violated when the officers lacked a reasonable, articulable suspicion that the Defendant was engaged in criminal activity when he was found in a high crime area and did not respond to the officers’ commands to show his hands.
