Assignment of Error

 

The Circuit Court erred in denying Ferguson’s motions to strike Furr’s evidence and to set aside the verdict by refusing to allow Ferguson to present its statute-of-limitations defense to the jury and rejecting Ferguson’s jury instructions and jury question on that issue based on the mistaken belief that it had previously overruled Ferguson’s plea in bar on the statute of limitations when it had not.
