Deltona Business owner Corey Marion was fined by code enforcement for the crime of posting a sign to let people know that her business was a Toys for Tots drop-off site.
Seriously. Is local government anything more than a collection of code enforcement sticklers who have nothing better to do than to stop someone from being a Good Samaritan?
It is doubtful that Deltona's bureaucrats hate kids. Or charity. Or even charity for kids. But what these Grinches surely cannot stand is somebody questioning their authority by failing to correctly follow their labyrinth of rules.
In this case, Corey actually tried to follow Deltona's ridiculous regulations. When a code enforcement officer said the sign was too close to the road, Corey moved it nearer to her business, Happy Tails pet grooming.
But it didn't matter. Deltona fined her anyway and ordered her to remove the sign altogether, although she refused. The city also prevented another Toys for Tots drop-off site from posting the sign at all.
Interestingly, Deltona's municipal code grants "public agencies" an exemption from the law, but being a business owner shouldn’t mean waiving your right to free speech.
Corey’s fiancé, Jody, who was in the military said, quote, "I've been to Iraq and Afghanistan. I helped kids when I was there. Now to get a fine for helping kids in my country is outrageous. It's actually disgusting." What are the benefits of being a citizen again?
In other news, Carlos Miller writes at PhotographyIsNotACrime.com that a Miami cop was arrested for refusing to take off a mask and provide identification during a protest against Obamacare (he was off-duty and out of his jurisdiction).
While there is a law against wearing a mask in public, it’s meant to target people planning on committing robberies or hate crimes, even though it's been twisted to arrest protesters.
So he technically broke the law, but I'm wondering what would happen if he would try to beat the case in court with a First Amendment argument given there was no probable cause that he was planning on committing a crime involving an actual victim.
After all, the way the law is written, police could make mass arrests every Halloween night.
Carlos Miller is the founder and publisher of Photography is Not a Crime, a leading blog about free speech and press rights. Carlos publicizes examples of government overreach and the suppression of journalists’ rights. Although he frequently finds himself taking law enforcement officials to task with reporting, analysis and activism, Carlos never expected that his work would lead to a felony charge punishable by a decade in prison. Carlos was reporting on someone else’s story of an ordeal with the police, and at the end of his blog post, he published the public affairs telephone number. His readers flooded the office with calls, and Carlos was charged with felony witness intimidation...just for posting the police’s own public number on his website. After Carlos was charged, even more calls came in. Finally, the police called Carlos to inform him they had dropped the charges against him. They also begged him to make his readers stop calling. Kudos, Carlos, for using a peaceful strategy of phone calls and public pressure to achieve freedom.
