b"On today's 'BradCast': Justice John Paul Stevens, who led the liberal wing of the U.S. Supreme Court before retiring in 2010, passed away on Tuesday. IAN MILLHISER, constitutional law expert and Justice Editor at Think Progress, discusses Stevens' remarkable legacy, and how his tenure is so starkly different from the so-called "conservatives" now seated on the GOP's stolen Supreme Court. Millhiser also reports on the status of the legal challenge to the Affordable Care Act in the 5th Circuit Court of Appeals, brought by state Republican attorneys general seeking to strike down the landmark healthcare law in its entirety using a novel, "ridiculous" legal theory. He warns that if the case reaches the U.S. Supreme Court, it is unlikely to pass muster as long as the makeup of the court remains the same as it is today -- which, as Millhiser cautions, is not a guarantee. And there are ways that both the 5th Circuit and the Republicans challenging it could hedge that timing. An estimated 24,000 Americans will die each year if the Affordable Care Act is entirely struck down as plaintiffs seek -- and as a lower court judge ruled should happen.
