California uses loophole as excuse to not pay property owner

Cedar Point Tree Nursery is battling the state over property rights to their land. The state has a loophole for union organizers that allows them to come on to an agricultural grower's property 120 days per year, 3 hours a day to try and persuade the property owner to join the union. California government is using this as reason to not compensate the owner because part of the land is not occupied 24/7. Professor of Law at George Mason University Ilya Somin joins John Howell to explain why this is such an important case.
