Judge Krista Marx ruled on Tuesday that there was not a sufficient amount of evidence to open up the grand jury testimony from the original case in 2005.

The Judge told the appointed prosecutor that he had provided no evidence in support for his rather unusual request to get the records from a Grand Jury.

Prosecutors are not conducting interviews with victims to bring more evidence to the judge in hopes of swaying her decision.
