On today's 'BradCast':\xa0 It's always darling when Republicans pretend to oppose 'activist judges' who 'legislate from the bench.'\xa0 The new Republican majority on North Carolina's Supreme Court is now showing how it's done!\xa0 Election law professor JOSHUA A. DOUGLAS explains the latest developments in the 'Moore v. Harper' case recently heard at the U.S. Supreme Court, which could upend decades of election law through a fringe legal concept called the 'independent state legislature theory' that would grant gerrymandered state legislatures sole, unreviewable authority to decide elections in each state, including choosing presidential electors regardless of the will of the voters. But in a truly unprecedented move, the new Republican majority on the North Carolina State Supreme Court wants to rehear the original case. Douglas explains the 'brazen power grab by the new majority', its implications for the state and national elections in advance of the critical 2024 Presidential Election, and the politicization of the judiciary at all levels. Also today:\xa0 we received a lot of fascinating listener comments on our previous call-in program regarding whether the U.S. should continue to support sovereign Ukraine in defending itself from Russia's brutal, unlawful invasion.
