North Carolina state law requires candidates meet all requirements for office that are explicitly detailed in the U.S. Constitution, and the complaint presents evidence that Cawthorn reportedly helped organize the rallies before the deadly attack on the U.S. Capitol on January 6, 2021, and voted to reject the certification of Joe Biden's Electoral College victory despite no evidence of fraud. The challenge is serious enough that Cawthorn has filed a lawsuit to block the inquiry.
